Rome Clifford Katz & Koerner Partner Steve Katz secured a Connecticut Appellate Court win for a client in a contested estate case for a second consecutive month in June.

In the most recent positive outcome, released June 25, the Appellate Court affirmed the decision of the trial court in a case involving a denied claim for caregiving services filed by the plaintiff, who had lived with his grandfather, Robert Olson, for approximately thirteen years prior to Olson’s death.

Attorney Katz successfully represented the defendant, Christopher Olson, Executor of the Estate of Robert Olson, who denied the plaintiff’s claim requesting $741,048 for caregiving services, a figure that increased to $1,106,175 in a supplemental claim. The decedent’s last will and testament did not include the plaintiff as a beneficiary.

Attorney Katz represented the defendant in the trial court and appellate court levels. In the trial court case, the plaintiff argued various breach of contract claims and other claims seeking monetary damages for alleged caregiver services. The defendant argued that all services performed by the plaintiff grandson were done without any expectation of payment beyond living rent free in the decedent’s home for years. After a lengthy trial, the jury found that the plaintiff grandson failed to prove any of his claims and found in favor of the defendant Executor.

In Connecticut Appellate Court, the plaintiff claimed that the trial court improperly instructed the jury regarding the applicable burden of proof, improperly instructed the jury on a statute of limitations defense, improperly admitted into evidence certain testimony, and improperly permitted the defendant to present the testimony of undisclosed rebuttal witnesses.

The Appellate Court affirmed the judgment of the trial court in favor of the defendant on all claims.

Attorney Katz said the Appellate Court properly affirmed the jury and trial court decision. “The jury saw through the baseless claims and sent the plaintiff away with nothing as he deserved. Hopefully the family of the decedent, Robert Olson, can finally get some peace and closure after these unsupported claims emotionally and financially drained the family for years.”
